**General Terms and Conditions (GTC)**  

of  Yes Music AG, Switzerland

**1. Scope, Contract Conclusion**

1.1  

These Ticket GTC apply to all concerts where Yes Music Switzerland AG, Managing Director Rene Baumann, Breitenweg 6, 6370 Stans (hereinafter referred to as the Organizer) is the organizer. In particular, these GTC govern the relationship between the attendees (hereinafter referred to as you, buyer, or ticket holder) and the Organizer.

1.2  

The contract between you and us is concluded through our distribution partners Ticketcorner, Eventim, as well as local sales points (hereinafter referred to as distribution partners) who sell the tickets on our behalf and at our expense. In addition to these GTC, the GTC of our distribution partner apply. In the event of conflicting provisions, however, additional notices from the distribution partners (e.g. regarding ticket personalization, transfer restrictions, ticket shipping date, etc.) must also be observed.

1.3  

The ticket purchase price, consisting of the base ticket price, presale fee, system fee, and other fees, including VAT (hereinafter referred to as "ticket purchase price"), is due immediately after the contract is concluded and is payable in full to the Organizer. Distribution partners may charge additional fees on their own behalf.

1.4  

Tickets are sold through our distribution partners with a retention of title, meaning they remain the property of the Organizer until the ticket purchase price has been paid in full and do not entitle the holder to attend the event until payment is completed.

1.5  

Children under the age of 6 are not permitted to enter the event, even if accompanied by an authorized adult. Tickets for children under 6 will not be sold. If there are any exceptions for specific events, we will inform you separately.

Children and adolescents under the age of 16 may only attend the concert if accompanied by an authorized adult who also holds a valid ticket. If the accompanying person is not a parent, they must be over 18 years old and present both their own ID and a power of attorney signed by the parents, along with a copy of the parents' ID. The authorized adult must supervise the child throughout the event. Adolescents under 16 will not be granted entry without an accompanying authorized adult.

Adolescents aged 16 to 18 are allowed entry without accompaniment until midnight; with an authorized adult, they may attend beyond midnight, provided they present a valid child or student ID. A third party is not allowed to purchase tickets for children. For adolescents, a third party may only purchase tickets if the above conditions for entry are met. If children or adolescents are denied entry because the conditions were not met, no refund of the ticket price will be made. Cancellations are not allowed.

These rules apply without exception, except for specially announced events.

1.6  

Attendance at an event with a discounted ticket is only allowed if the reason for the discount still exists at the time of the event and is proven upon entry. Otherwise, the right to attend the event only exists if the ticket holder pays the difference between the discounted and the regular ticket price. Eligibility for discounts is indicated in the event information or must be inquired about by the buyer. There is no entitlement to discounts in all categories.

Seats for visitors who are wheelchair users and their one companion are limited in number and location. Both must have tickets for the designated wheelchair area. Persons with walking disabilities should purchase a regular seating ticket. The ticket office will assist in finding suitable seating (e.g., aisle, ground-level seats).

1.7  

Once the tickets are handed over for shipping, the risk of accidental loss passes to the buyer. In the event of subsequent loss, there is no refund of the ticket purchase price or replacement tickets.

1.8  

Deviating or supplementary general terms and conditions of third parties, especially the buyer, will not become part of the contract without the prior written consent of the Organizer, unless otherwise agreed above (see section 1.2).

**2. Personalized Tickets**  

Special conditions apply to events with personalized tickets, in addition to these GTC and the specific personalization terms.

**3. Resale**  

The right to attend an event is non-transferable, except if the third party pays no more than the ticket's face value. An additional surcharge of up to 25% for expenses such as shipping and service fees is permitted. Transfer requires that the third party accepts all contractual obligations, especially the resale restrictions.

**4. Cancellation or Postponement of the Event**

4.1  

The Organizer explicitly reserves the right to cancel or postpone the event for reasons beyond their control (e.g., artist illness, force majeure) in advance.

4.2  

If the Organizer cancels the event per section 4.1, the ticket becomes invalid and does not grant admission. Claims for refunds of the ticket purchase price must be made to the respective distribution partner within 30 days of the event's cancellation date, as per section 4.5. If you are unable to meet the deadline for reasons beyond your control, proof must be provided.

4.3  

If the Organizer postpones the event per section 4.1, tickets remain valid unless you exercise your right to a refund. A refund is only available if the ticket is returned, and must be claimed by 24:00 the day before the rescheduled event, as per section 4.5.

4.4  

If the deadline is missed for reasons beyond your control, appropriate proof must be provided.

4.5  

For returns, please also observe the GTC of the respective distribution partner.

4.6  

Refunds are limited to the base ticket price including VAT (see section 1.3) upon receipt of the original ticket or print-at-home ticket by the distribution partner. Without this, no refund will be made. Fees (e.g., presale or system fees, per section 1.3) are non-refundable.

4.7  

Regarding fees charged by the distribution partner, please consult their GTC for possible refunds in the event of cancellation or postponement.

4.8  

These regulations do not affect your rights in case of a breach of duty by the Organizer.

**5. Liability Limitation**  

5.1  

Claims for damages are excluded, except for those arising from injury to life, body, or health or essential contractual obligations (cardinal obligations), or due to gross negligence or intentional breach by the Organizer, its legal representatives, or agents. 

5.2  

For breaches of essential obligations, the Organizer is only liable for foreseeable, contract-typical damage if caused by simple negligence.

**6. Assignment of Other Seats**  

The Organizer reserves the right to assign the ticket holder another seat within the same price category without any claims arising.

**7. Sound, Photo, and Video Recordings**  

Recording devices and cameras of any kind are prohibited. If such items are brought into the venue, they may be confiscated.

**9. Applicable Law, Data Protection, Jurisdiction**  

Swiss law applies to the contract. Exclusive jurisdiction is CH-Stans.

**10. Right of Withdrawal**  

As tickets are for leisure events, there is no right of withdrawal.
